To remain silent is to lie!
They are slowly but surely dismantling the constitution, they are unfolding this erosion before the nation's very eyes.
High judicial institutions always try to one-up one another, they foster a climate of contention, asserting themselves as arbiters in a looming clash.
They position themselves above all institutions, embedding their influence in the collective memory of society.
In their narrative, they perpetuate the notion that the Constitutional Court (AYM) consistently makes the wrong decisions, even going so far as to insinuate support for terrorist organizations.
This orchestrated assault gravely undermines the authority of the decree.
The foundational law of the Constitutional Court and the requisition for all state institutions to adhere to its rulings have lost their significance.
This isn't about Can Atalay anymore...
This decision regarding Can Atalay represents a fresh, targeted assault on the constitutional order!
WHAT'S BEYOND?
This question requires a direct answer:
What exactly is the government's true objective?
Among the state institutions, the Constitutional Court remains the lone entity retaining some oversight power over the government, giving the impression that it can act in this capacity.
The Court of Accounts, tasked with auditing government expenditures, functions as a financial court. However, this longstanding institution has been rendered effectively impotent. Many of its pivotal reports crucial for budget negotiations echo the phrase "No information could be found."
The Council of State, entrusted with administrative oversight, possesses scant potential for counterbalancing government decisions.
The recent crisis involving the Court of Cassation illustrates its compromised position. While criticism of the Constitutional Court's decisions is permissible, initiating criminal proceedings against those responsible for these decisions is an entirely different matter. When an institution charged with upholding the Constitutional Court's decisions neglects this duty and instead files criminal complaints against its members, it throws the very legitimacy of the process into question. As highlighted earlier, any discussion based on legal grounds becomes untenable after this stage. However, one can ponder the objective sought through such legal action: to downgrade the Constitutional Court to the level of other high courts under the guise of restructuring.
Disregarding the Constitutional Court equates to disregarding the Constitution itself.
Disregarding the Constitution undermines the entire constitutional framework within which the government operates.
Disregarding this framework paves the way for a system devoid of order, eroding its legitimacy.
What lies beyond all this?
FIGHT FOR DEMOCRACY
Beyond that, there lies a more controversial situation.
In any personal regime, the consolidation of powers within one's grasp tends to be unending. The quest for more power is perpetual.
There exists no definitive endpoint; in the fight for democracy, there's always a new way to go.
In navigating democracy's landscape, there's no such thing as a final escape route before a bridge; there's always another exit following the last bridge.
The current situation we're in manifests the government's concerted effort to eradicate the last vestiges of the rule of law. Every serving member of the Constitutional Court assumed office during this government's tenure. As ownership expands across all realms, it leads to a situation that is unsuitable.
We're witnessing a stark, tangible illustration of this phenomenon.
Regrettably, the recurring image that often comes to mind with dictatorship is this: not merely one person governing millions, but millions conceding to the tyranny of a single individual.
Before the eyes of 84 million people, the Constitutional Court is being used as a vessel to shred the constitutional order.
Remaining silent in the face of this is tantamount to falsehood!
Until a more viable alternative emerges, upholding the existing constitution forms the bedrock of democracy and the grounds for our struggle.
Law faculties, trade unions, mass organizations, and professional bodies, your purposes are being questioned!
